Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Auris ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. You must be at least 13 years old to use the Services.

2. Description of Services

Auris is a macOS application that provides on-device voice transcription, AI-powered text refinement, screen-aware assistance, and voice commands. The App includes both free features (on-device transcription) and paid features (AI refinement, commands, screen-aware help) available through a subscription.

3. Your Account

To access paid features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access.

4. Your Content

A. Ownership

You retain all ownership rights to your content, including transcribed text and any AI-generated outputs. Auris does not claim ownership of any content you create using the Services.

B. AI Inputs and Outputs

When you use AI features, your transcribed text ("Input") is processed to generate refined text ("Output"). You own both the Input and Output. We do not use your content to train AI models.

C. No Warranty on AI Outputs

AI-generated outputs may contain inaccuracies. You should review all outputs before use. Auris makes no representations or warranties regarding the accuracy, completeness, or suitability of any AI-generated content.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Reverse engineer, decompile, or disassemble the App
  • Attempt to circumvent any security measures or access controls
  • Use the Services to generate harmful, abusive, or illegal content
  • Record or transcribe another person's speech without their consent
  • Resell or redistribute the Services without authorization

6. Subscription & Payment

A. Free Tier

On-device transcription (Raw mode) is free, unlimited, and does not require an account or payment.

B. Paid Subscription (Auris Pro)

Paid features are available through a monthly ($9.99/month) or annual ($99.99/year) subscription. Subscriptions automatically renew unless cancelled before the renewal date.

C. Free Trial

New users receive a 7-day free trial of Auris Pro. No credit card is required to start the trial. After the trial ends, you will be prompted to subscribe to continue using Pro features.

D. Cancellation

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation, you retain access to paid features until the end of your current billing period. No refunds are provided for partial billing periods unless required by law.

E. Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice.

7. Privacy

Your use of the Services is also governed by our Privacy Policy. Key points: audio never leaves your device, transcribed text sent for AI processing is not stored, and we collect minimal anonymous telemetry.

8. Intellectual Property

The App, including its code, design, and documentation, is owned by Auris and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the App as described herein.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Auris from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services if you violate these Terms. You may stop using the Services at any time. Upon termination, your right to use paid features ceases, but the free tier remains available.

13. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
